Topic: History of Mining Law: The mining laws of the West were generally the product of common practices of the miners that were memorialized in “mining district regulations.” The regulations promulgated in the mining districts of California beginning in 1850 were the classic examples. Arizona Territory initially took a different path as a result of the influence of the laws of Mexico and when the first legislative assembly met in Prescott in 1864, the resulting mining law looked very much like the Ordenanzas of Mineria of 1783. These laws included innovations for the acquisition of auxiliary land, support of public schools and specific provisions for litigation of mining disputes. Unfortunately, these advancements only lasted until the enactment of the first federal laws in 1866.

Bio: John Lacy is a mining lawyer in the Tucson office of DeConcini McDonald Yetwin & Lacy and also the Director of the Global Mining Law Center at The University of Arizona’s James E. Rogers College of Law. He grew up in a mining camp in Peru and went to high school, college and law school at The University of Arizona. He has represented mineral exploration and mining clients since graduation from law school in 1967 and has taught mining law and related subjects since 1972. John is frequently distracted by his interest in history and has written historical papers served on various boards of the Arizona Historical Society for many years. He is also the president of the Arizona History Convention which puts on annual programs on Arizona historical subjects.
